Annual monitoring of migratory birds at Lista and Jomfruland bird stations. We have considered that for this contract there is only one tenderer and that it therefore comes under the sole supplier exception in the Public Procurement Regulations §13-4 first paragraph (b). The wording is "competition is impossible for technical reasons". This is justified in the following conditions: The Norwegian Environment Agency needs a long and thorough time series that monitors the migratory birds' arrival to Norway and how this changes over the years, especially in connection with climate change. Thus, BirdLife has Norway its bird stations at Jomfruland and Lista for many years maintained such a time series, and is the only tenderer with a sufficient number of resources, technical infrastructure and professional competence to continue monitoring and ensure continuity in the time series. There are probably no other suitable ways to obtain such knowledge of sufficient quality. Particular access to unique physical installations and high competence suggests that it is impossible for others to offer an equivalent product. We therefore believe that the terms for the procurement without competition are fulfilled.
