DBO/0081 Limerick Main Drainage Long Term Operate & Maintenance Contract

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU.

The additional works and spend are necessary to maintain the operational continuity of the Limerick WWTP, which serves as a regional sludge hub. The existing sludge tanks have deteriorated beyond serviceable condition and now require prompt replacement to ensure compliance with health and safety standards and to mitigate environmental risks. The integration of these works within a live operational environment necessitates a carefully sequenced approach involving flow diversion and phased access, which can only be safely and efficiently delivered by the Contractor. A change of Contractor at this stage would have caused: 1) Cross liability risks in relation to changing the contractor responsible for running the relevant WWTP and Sludge Hub; 2) significant inconvenience and disruption to UÉ daily operational requirements; 3) substantial duplication of costs (e.g. training, mobilization, data collection and analysis methodology); and 4) discontinuing of detailed knowledge and expertise associated with running the interested asset. Total contract value before the modifications, Value excluding VAT: €75,715,940.91. Total contract value after the modifications, Value excluding VAT: €80,576,530.55.
