21/095 - Statutory Inspection of Lifting Equipment

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU.

The existing Contractor's engagement for a longer period (to March 2026) and the additional spend have become necessary to allow for the completion of the replacement tender competition (reference: 24/021QS) and where the change of Contractor would have caused: (1) cross liability risks in relation to changing the contractor responsible for the continued provision of Statutory Inspection services as required by Safety, Health and Welfare at Work (General Application) Regulations 2007 (S.I. No. 299 of 2007), as amended; (2) significant inconvenience and disruption to Uisce Éireann operational requirements; and (3) substantial duplication of costs.

Additionally the modification of the contract during its term (under Art 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU) is also brought about by the unforeseeable circumstances surrounding the establishment of the qualification system ref. 24/021QS and the subsequent launching of the first call for competition which is currently ongoing.

The Contracting Entity requires to retain the services of the existing Contractor for a longer period (to March 2026) to avail of uninterrupted statutory inspection of lifting equipment services until the new competition is concluded.
